United vs. Texas

On June 23, 2016, by a 4-4 decision, the United States Supreme Court in United States v. Texas  affirmed the decision of the Court of Appeals for the Fifth Circuit which temporarily blocked the implementation of  two deferred action programs announced by President Obama in November 2014 intended to help select groups of undocumented immigrants work legally and remain in the United State temporarily. The first program, the Deferred Action for Parents of Americans and Lawful Permanent Residents (DAPA) would help undocumented parents of U.S citizens and permanent resident children, and the other program would have expanded the Deferred Action for Childhood Arrivals program (DACA) created in 2012 to help undocumented immigrants who came to the U.S. as young people. That second program is referred to as Expanded DACA. The Court of Appeals decision upheld the preliminary injunction granted by the United States District Court for the Southern District of Texas to prevent the Obama administration from implementing these programs until the underlying legal challenge asserted by several states could be heard and decided by the court.

Due to these court decisions, applications for DAPA or Expanded DACA are not available at this time. You can visit the United States Citizenship and Immigration Services website and subscribe to get regular updates and information on these programs.

NYC residents who are eligible immigrants may currently apply for DACA. NYC offers support to immigrants through ActionNYC seeking to apply for DACA and other immigrant authorizations. You can learn more about ActionNYC by visiting its website.

Also, NYC immigrants who are uninsured and do not qualify for Medicaid or other public health insurance programs due to their immigration status may be eligible to enroll in ActionHealthNYC, a new low-cost health care access program. ActionHealthNYC offers members primary and preventive care, specialty care referrals and dental benefits at eight primary care homes in Queens and Lower Manhattan/Chinatown.
